Legal rights of children when the parents divorced Print E-mail
Questiom:
What are the legal rights of children when the parents divorced and the children lived with the mother, who remarried? The divorced husband had a previous wife with no children and is currently married with children, residing in the UK.?


Answer:
According to the Qur'an and Sunnah the children are the first and foremost inheritors of what belongs to the father, no matter whether they are living with him or not and also whether their mother is divorced from the father or not. That is according to Shari'a and should be applicable in Pakistan. As far as the UK is concerned, Islamic law does not govern it and hence the children from Pakistan may not get anything from their father but Islamically they are entitled to.
