What uses can the old mosque property have or what can it be converted in to? |
|
|
|
Answer:
A place that has been declared as a mosque by the Trustee is to be considered as Waqf not subject to sale except if all the proceeds of the sale are to be used to buy another place of worship or used to maintain the new mosque.
We know in the history of the Caliphates, that Syeddina Umar (RA) found a mosque at the dates market in Kufa, very crowded with no site to expand. So he relocated it to a different site. With these guiding remarks in mind, on can say that:
A. The Trustees can sell the existing property
B. They are allowed to change its use to dwelling places provided that the rent is used to maintain the new mosque
C. They can use the existing property as a Madrasa or Islamic Institute because this new use of the property doesn't negate the objective for which the property was acquired initially.
D. Can be used as Halal business providing that the proceeds go towards the new mosque
E. It cannot be used for any other purposes contradicting to its primary purpose i.e. worship and Islamic teaching. For example it cannot be used as a sports centre.
