If my father or brother refuse to be my wali can I still marry this man? |

Question:
I am a 34 year old single woman, living with my brother. I feel the need to marry as I am not getting any younger. My family have said they require someone matching our ethnicity. I follow the hanafi Madhab and have been practicing for 5 years. Recently I have received a proposal from a practicing Muslim and personally would like to accept the proposal. The problem is he is from a different ethnicity. My father and has met him and was very reserved and rude to him. I would like to know, if my father or brother refuse to be my wali can I still marry this man?
Answer:
Dear Sister, in as far as choosing the life partner is concerned, preference must be given to deen (religiosity), then comes beauty, nobility and wealth according to the hadith. If you have found the brother to be of suitable Islamic nature, then go ahead with this without any hesitation as you have done istikhara as well.
If worse comes and your father and brother are not coming forward in this matter, still you can go ahead with as a grown up girl can marry without Wali according to the Hanafi Madhab. You are well advised of course to be good with your parents at all times however they may behave.
