Question:
I hope you can be of some help. I am writing to ask for some advice on behalf of a friend. At the time of her nikaah she was pregnant with another man's child. She was unaware of this at the time. Would the Nikaah still be vaild?
Answer:
The Nikah whilst she was pregnant, is not valid. They should separate at once. If the child was from a previous marriage, then she has to seek divorce from the first husband, pass Iddat period and then contract a fresh marriage. If it was a child from Zina (fornication), she must repent to Allah sincerely and separate from the man immediately. She is allowed to have a fresh Nikkah with the man after separation.
