What is the role of a guardian in a marriage? |
The preferred opinion among the Muslim jurists is that a woman requires the consent of her Wali (her male guardian e.g. father, grandfather, uncle, brother) at the time of marriage. If the guardians of a woman disagree among themselves, then the Muslim Ruler will be her Wali. In a non-Muslim country, such a role can be played by a person of authority like the Imam of a mosque or the Head of an Islamic Organization.
According to the Hanafi jurists, an adult woman does not need the permission of her Wali for marriage.
