| conditions of fasting |

The requirements of fasting must be fulfilled before the fast is
considered as an obligation and also whether it is acceptable or not.
These conditions are some agreed upon and some there are difference of
opinions in the finer details. We will mention them as concise
inshAllah. Condition1 : Islam. The scholars have agreed upon that fasting is not compulsory upon a non-believer in this dunya. Moreover, he is not required to make them up after he embraces Islam for the years he missed fasting because the obligation was not set upon him whilst he was a non-Muslim. This is the view of majority of the scholars such as Imam Ahmed, Shaf'ee, Maalik, Awza'i, Abu Thaur and others. There is an opinion mentioned by At'a that he has to make up for the fasts he missed during Ramdan. However, the correct stance is that which has been held by majority of scholars because the Prophet of Allah (peace be upon him) never obligated upon people who converted to Islam to makeup for their missed fasts or prayers. Condition 2: Bulugh (Adulthood) Fasting is not incumbent upon children before they reach the age of adulthood based upon the narration, "The pen has been lifted from three; a child until he reaches puberty, (in another narration) until he has sexual dreams, from an insane person until he becomes sane and from a sleeping person until he wakes up". However, if the children are capable to fast and they have reached the age of 7yrs then it is a must upon their parents to order them to fast with the condition that they are at the age of discering. Imam Shaf'i and Imam Ahmed said to beat the child (lightly) if they have reached the age of 10 yrs and they do not keep fast even if for them in essence it is not obligatory but because if they keep fasting then it will be acceptable from them and for this fact they should not leave fast. However, to beat them for leaving fast if they have reached the age of 10yrs is using analogy on leaving prayer. This analogy is incorrect because the evidence specifically speaks about prayer and not fasting. Hence, the correct stance is that the parents should encourage their children to fast and teach them the benefits of fasting and the great rewards but to say that we should encourage beating them aswell is not correct. Condition 3: Intellect. Fasting is not prescribed upon an insane person due to the hadith mentioned earlier. If he becomes sane after the sunrise or for the days he missed during Ramadan then there is no compensation upon him or he is not required to make them up because the obligation of fasting was not directed towards him whilst he was in that state. However, this ruling differs for a person who becomes unconscious during Ramadan and then wakes up. He has to makeup for the missed days because unconsciousness is an illness and not insanity and hence they are two separate issues. This has been explicity mentioned by Imam Shaf'ee and Ahmed bin Hanbal. Condition 4: Purity from menses and Nifas (post natal bleeding) The scholars have unanimously agreed that a woman who is in her menses or nifas then it is prohibited upon her to keep fast until she becomes pure. When they become pure then they have to makeup for the missed fasts. If a woman comes on her menses in any part of day before the sunsets then her fast is broken even if there was a minute left before closing the fast. If she becomes pure from menses or nifas during the day, should they stay away from food or are they allowed to eat? Imam Shaf'ee took the stance that it is better to keep away from the food until sunset so they should avoid eating things which breaks one's fast. Imam Ahmed had two stances in this issue; one was obligation for them to keep away and second as a recommendation only. Imam Maallik said that they should not stay away from eating or from any other action which would spoil one's fast. Rather, they should eat, drink if they so wish because the prohibtion was for the one who was obliged to fast from dawn to sunset and they were excused so they should carry on with that state until they are required to keep the fast. |
